In 2022, the Gilbert Law Firm filed a class action lawsuit and an individual lawsuit naming MultiCare Health Systems and Dr. Jason Dreyer, D.O. as defendants, alleging medical negligence, fraud and RICO violations. In April, 2022, the Gilbert Law Firm also filed a False Claims Act (Qui Tam) action under seal in Federal District Court naming MultiCare Health Systems and Dr. Jason Dreyer, D.O. as defendants and asserting claims that the defendants committed medicare and medicaid fraud.
The case evolves out of a scheme precipitated by Dr. Jason Dreyer to increase his production bonus income. MultiCare spine surgeons are paid on a production bonus salary structure.
For several years, Dr. Dreyer conducted unnecessary and overly complex spine surgeries without appropriate indication for the surgeries to increase his salary.
MultiCare was aware of Dr. Dreyer’s propensity to perform these surgeries and ignored the issue because it benefited from the overly complex and unnecessary surgeries. As a result of this pattern and practice of negligent, violative, unethical, and fraudulent treatment, hundreds of patients have been permanently harmed. These facts are the focal point of the Government’s claims, as well as the class action filed by the Gilbert Law Firm.
Now, with the help of the Gilbert Law Firm, the United States and the State of Washington are seeking reimbursement for the fraud committed by Dr. Dreyer and MultiCare for knowingly endangering patients and fraudulently billing for Dr. Dreyer’s spinal surgery procedures.
